Consultation draft regulation on the complaint postal service will run until June 24. The proposed priority express rules are intended to unify the complaint procedures, empower consumers and facilitate their contact with the operators electronically. Regulation relating to the entry into force of the new Postal Act liberalizing the postal market - from 1 January 2013. Abolished the reserved area for the Polish Post. The need to issue this regulation is based on Art. 92 section 4 of the Act of 23 November 2013. Postal Law (OJ poz.1529).
Provisions contained in Regulation aims to harmonize the complaint for failure to perform or improper performance of the postal service. They will replace the Regulation of the Minister of Infrastructure of 13 October 2003 on the complaint of universal postal service in terms of registered mail and postal order (Journal. Laws No. 183, item. 1795, as amended. D.).
So far, the existing regulation related priority express only to universal services that are critical priority express from the point of view of satisfying social needs for postal services and for this reason are guaranteed by the state. For other services, each of the operators priority express defined priority express complaints procedure independently on its own rules of provision of postal services.
The proposed regulation is intended to harmonize complaint procedures for all postal services which empower consumers to existing postal operators claim in the event of non-performance or improper performance of the services.
The draft defines the rules for the submission of complaints and handling. It was also the cases in which the operator priority express does not take the actions provided for in the complaint procedure results in recognition of the complaint. This is an important provision to protect priority express consumers against the inaction of the operator.
The Regulation also important to facilitate the consumer through the possibility priority express of electronic communication service provider throughout the complaint procedure starting from the claim, except when precluded by the technical priority express capabilities of the operator.
The draft regulation with the justification is available on the Legislative Process Government. Comments can be submitted via the portal mamzdanie.org.pl, delivery mailbox ePUAP and by post at the Ministry of Administration and Digitization, ul. Royal 27, 00-060 Warsaw.
